TERMS AND CONDITIONS

Welcome to www.writeyourwayhome.net (“Site”), operated by Edward & Lewis LLC (“Company,” “we,” “us,” or “our”). These Terms and Conditions (“Terms”) govern your use of the Site, including participation in the “Write Your Way Home Essay Contest” (“Contest”).

By accessing or using this Site, you agree to be bound by these Terms and our Privacy Policy at [insert link to Privacy Policy] which is incorporated by reference. If you do not agree, do not access or use this Site.

1. ELIGIBILITY
You must be at least 18 years old to use this Site or enter the Contest. Use is void where prohibited by law.

2. CONTEST RULES INCORPORATED
Your participation in the Contest is also governed by our Official Contest Rules, which are incorporated by reference. In case of conflict between these Terms and the Official Contest Rules, the Official Rules govern Contest participation.

3. SITE CONTENT
The Site and all content on this Site—including text, images, graphics, logos, videos, features and software, and the design, selection, and arrangement thereof (collectively, “Content”) —is owned by Company or its licensors and is protected by U.S. and international copyright, trademark, and other intellectual property laws. You may not copy, distribute, modify, or create derivative works from any Content without our express written consent.
You must not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the Content other than as explicitly authorized herein, including for any purposes that are competitive with the Contest or our services.
You must not modify the Content in any way, including deleting or altering any copyright, trademark, or other proprietary rights notices. Use of the Site is for your own personal use only as described herein, and not for other purposes, and you may not access, download, view, or otherwise use any Content in any manner that is not expressly permitted. No right, title, or interest in or to the Site or Content is transferred to you, and all rights not expressly granted are reserved by us. Any use of the Site not expressly permitted by these Terms may violate copyright, trademark, and other intellectual property or proprietary rights laws. When accessing the Site, you agree to obey the law and to respect the intellectual property rights of us and others. You agree that you shall be solely responsible for any violations of any applicable laws and for any infringement of third-party rights caused by any User Content (as defined below) that you provide or transmit to us.
Company grants you a non-exclusive, non-transferable, limited right to access and use the Site subject to these Terms. Only visitors of the Site that agree and abide by these Terms and that may legally use the Site and Content under all applicable laws are granted the license provided for herein. You are solely responsible for your use of the Site and Content, including the use of or reliance on the same. Without limiting the generality of the foregoing, you are responsible and liable for all actions and failures to take required actions with respect to the Site, Content, and Contest, whether such actions are permitted by or in violation of these Terms.
4. USER CONTENT
If you submit any text, content, or other materials to us via the Site, including essays for the Contest (collectively, “User Content”):

You grant us a non-exclusive, worldwide, royalty-free, irrevocable, sublicensable license to use, reproduce, display, and distribute User Content for Contest administration and promotion.

You represent and warrant all User Content is original, does not infringe any third-party rights, and complies with applicable laws. As described in further detail in our Official Contest Rules, you represent and warrant that User Content, including your Contest entry, is original, not plagiarized, and was not created using ChatGPT or other similar generative AI tools. Should you win the Contest, you agree to sign an affidavit attesting to the foregoing.
We are not responsible or liable to any third party for the content or accuracy of any User Content posted by you or any other user of the Site.
Any feedback, suggestions, questions, comments, ideas, notes, concepts, and other similar information that you provide to us (“Feedback”) is owned by us and considered the proprietary information of the Company. We may use or determine to not use Feedback for any purpose in our sole discretion without any attribution or compensation to you, including, but not limited to, improvement and modification of the Site, Contest, or other services. We own all rights, title and interest in and to the Feedback and such improvements and modifications, and you acknowledge and agree that you have no rights to the Feedback or such improvements and modifications.
Any personal information submitted to us through the Site shall be subject to our Privacy Policy.

5. PAYMENT
Participation in the Contest requires payment of a $200 non-refundable entry fee unless otherwise stated in the Official Rules. All payments must be made via our designated payment processor. We do not store payment card details on our servers.

6. PROHIBITED CONDUCT
You agree not to:

Violate any applicable laws or regulations.
Submit false, misleading, or infringing content. -
Disrupt, damage, or interfere with the Site’s operation.

Impersonate any person or entity.

Use automated systems to access the Site.
We reserve the right to suspend or terminate access for any user violating these Terms.

7. DISCLAIMER OF WARRANTIES
This Site and all Content are provided “as is” and “as available.”
We disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not guarantee the Site will be error-free or uninterrupted.
COMPANY ACCEPTS NO LIABILITY OR RESPONSIBILITY FOR ANY LOSS OR DAMAGE OF ANY KIND ARISING OUT OF YOUR ACCESS OR USE OF THE SITE OR AS A RESULT OF ENTERING THE CONTEST, WHICH ARE ACTIVITIES UNDERTAKEN SOLELY AT YOUR OWN RISK.

8. LIMITATION OF LIABILITY
To the fullest extent permitted by law, Company and its affiliates, officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Site or participation in the Contest. Our total liability for any claim relating to the Site or Contest will not exceed the greater of $100 or the entry fee you paid.

9. INDEMNIFICATION
You agree to indemnify and hold harmless Company, its affiliates, officers, employees, and agents from any claims, losses, damages, liabilities, costs, or expenses (including reasonable attorneys’ fees) arising from:

10. GOVERNING LAW AND DISPUTES
These Terms are governed by the laws of the Commonwealth of Virginia, without regard to conflict-of-law principles.
11. CHANGES TO TERMS
We may update these Terms at any time. Changes will be effective when posted on the Site with the updated Effective Date. Your continued use of the Site after changes constitutes acceptance of the revised Terms.

12. TERMINATION
We may suspend or terminate your access to the Site at our sole discretion, without notice, for conduct violating these Terms or applicable law.
13. SEVERABILITY
If any provision of these Terms is found invalid or unenforceable, the remaining provisions will remain in full force and effect.

14. ENTIRE AGREEMENT
These Terms, together with the Privacy Policy and Official Contest Rules, constitute the entire agreement between you and Company regarding your use of the Site and participation in the Contest.
